New issue:

Seems that the new setup is not following the rules, it sees the config saying time out 40 times but does it once and then delivers the mail... any hints ???

IMO one should set the timeout ridiculously high (several minutes) so that
MS never interrupt SA. This was true for bayes expiry problems back when
everyone had them as files that ... grew insaly huge over time (bayes_seen
in the multi-hundred MiB to GiB range might be a problem in this case...
Simple fix though, just delete:-).

Increasing the timeout would at least avoid the problem of
interruption/delivery.

Cheers!

Seems that the new setup is not following the rules
what new setup? Are you talking about moving from SA 3.3 to 3.4?
I did months ago. I haven't seen any issues.
